Terms and Conditions

TERMS AND CONDITIONS OF PARTICIPATION-RANAU 45K ULTRA MARATHON 2022

This event is an extreme outdoor ultra-marathon event that may expose participants to extreme heat or extreme cold and extreme elevation and should only be attempted by experienced participants who deem themselves to be fit, conditioned and prepared for such an event.
 

If a participant has doubts over his or her abilities, it is his or her responsibility to seek advice from the organizers, Avta Sports Sdn Bhd if this event is suitable for them and what steps they must take to prepare for this extreme endurance event.
 

The ‘Organizer’ is Avta Sports Sdn Bhd
 

The ‘Participant’ is the individual who has paid to participate in this event
 

𝟏-𝐌𝐢𝐧𝐢𝐦𝐮𝐦/𝐌𝐚𝐱𝐢𝐦𝐮𝐦 𝐚𝐠𝐞 𝐭𝐨 𝐏𝐚𝐫𝐭𝐢𝐜𝐢𝐩𝐚𝐭𝐞:
 

21 years or older on race day or a maximum of 65 years or age or younger on day of event
 

𝟐-𝐀𝐥𝐥 𝐜𝐨𝐦𝐩𝐞𝐭𝐢𝐭𝐨𝐫𝐬 𝐚𝐫𝐞 𝐫𝐞𝐬𝐩𝐨𝐧𝐬𝐢𝐛𝐥𝐞 𝐢𝐧 𝐞𝐧𝐬𝐮𝐫𝐢𝐧𝐠 𝐭𝐡𝐞𝐲 𝐚𝐫𝐞 𝐦𝐞𝐝𝐢𝐜𝐚𝐥𝐥𝐲 𝐟𝐢𝐭 𝐭𝐨 𝐩𝐚𝐫𝐭𝐢𝐜𝐢𝐩𝐚𝐭𝐞 𝐢𝐧 𝐭𝐡𝐢𝐬 𝐞𝐯𝐞𝐧𝐭 𝐚𝐧𝐝 𝐝𝐨 𝐧𝐨𝐭 𝐬𝐮𝐟𝐟𝐞𝐫 𝐟𝐫𝐨𝐦 𝐚𝐧𝐲 𝐨𝐟 𝐭𝐡𝐞 𝐦𝐞𝐝𝐢𝐜𝐚𝐥 𝐜𝐨𝐧𝐝𝐢𝐭𝐢𝐨𝐧𝐬 𝐬𝐭𝐚𝐭𝐞𝐝 𝐛𝐞𝐥𝐨𝐰:
 

o Congenital or rheumatic heart conditions

o Hypertension

o Myocarditis and other heart conditions

o Coronary heart-disease, coronary arterial disease

o Serious arrhythmia

o Diabetes (*refer to race organizers for more information)

o Vertigo

o Any other major diseases that can be aggravated by running in extreme conditions and/or under extreme weather or long distance with extreme elevation gain
 

𝟑-𝐂𝐨𝐯𝐢𝐝-𝟏𝟗 𝐏𝐫𝐨𝐭𝐨𝐜𝐨𝐥𝐬
 

Due to the new social distancing norms and Standard Operating Procedures (SOP) as a result of Covid-19, participants acknowledge they understand that new protocols must be introduced for the benefit of all concerned and willingly submit themselves to these new SOPs and agree to adhere to the stated SOPs below.
 

•“Revised SOP” means the organizer may need to adjust/change or modify SOP’s due to new requirements by the “authorities” listed below:
 

•These new protocols are guided by guidelines and SOP’s International Trail Running Association (ITRA) guidelines, and/or Kementerian Kesihatan Malaysia and/or , Department of Occupational Safety and d Health, Ministry of Human Resources, and/or Kementerian Belia dan Sukan and/or Persuruhan Jaya Sukan Negara Malaysia (also known as “The Authorities.”)

•Please note the protocols below may be subject to change on advice from the Sabah State Government or any of the authorities listed above which includes potential change to start times, format of the start and finish, change in location for start or finish locations due to Covid-19staggered start times, and/or delayed start times/earlier start times.

•Participant must be double vaccinated in order to participate. No appeals for waiver will be entertained due to government SOP's. Participants will be required to show proof of being fully vaccinated when registering and on the day of race pack collection as well as well as the race day. If The Authorities demand testing prior to the event, competitors will need to show proof of health in order to participate.

• Participant showing signs of illness on the day of the event and/or demonstrating a body temperature of over 37.5 degrees Celsius must withdraw from the event immediately and may not participate in this event and should immediately inform the organizers.

• Signs of illness may include fever, cough, excessive sneezing, shortness of breath, sore throat, headache.

• If a runner has to withdraw due to injury or other illness, they must inform the organizers as soon as possible.

• No support crew, friends/family, third parties will be allowed in the designated start line or finish line area of the event as per SOP’s. You Your support crew, friends/family or third parties may stand outside the start area at a sensible distance.
 

The co-operation of support crews, friends/family in this regard is sincerely appreciated as social distancing limits prevent us from allowing too many people into the start area.
 

𝟒-Entry Fee for Event will be introduced in 2 formats:
 

-Early Bird Rate or early entry fee for the first 100 runners excluding basic insurance cost

-Standard Entry Fee rate for all runners after the first 100 runners excluding basic insurance cost
 

The entry fee includes a finisher tee, finisher medal, event bib and finisher medal if the participant completes the entire route by the cut off time unless a special waiver is given by the race director that allows a participant to finish outside of the designated cut off time.
 

Optional purchase of transportation to the race venue and event merchandise will be made available.
 

𝟒-𝐈𝐧𝐬𝐮𝐫𝐚𝐧𝐜𝐞 𝐂𝐨𝐯𝐞𝐫𝐚𝐠𝐞
 

Basic insurance coverage is mandatory for participation in this event which is calculated separately from the basic entry fee (Early Bird Rate or Standard Rate).All participants must be insured in order to participate. Insurance coverage is 21 years of age to 65 years of age on the event date. All participants are required by PJS (in full pls) laws to attain have purchased insurance coverage from the organizer at a set rate payable for this event.
 

𝟓-𝐒𝐮𝐛𝐦𝐢𝐬𝐬𝐢𝐨𝐧 𝐨𝐟 𝐌𝐘𝐊𝐀𝐑𝐃 𝐂𝐨𝐩𝐲

All participants must submit a clear photocopy or photograph of their MYKARD to the organizers before the event in order to participate. MYKARD copies are safely kept for emergency medical admissions only and to verify participants identity and for insurance purposes.

Copies of all MYKARDS will be are deleted at the end of the event and no personal MYKARD submissions are shared with 3rd parties
 

𝟔-E𝐁𝐚𝐬𝐢𝐜 𝐄𝐯𝐞𝐧𝐭 𝐑𝐮𝐥𝐞𝐬
 

𝐀. Participants are responsible for ensuring they understand, fitness levels and risks associated with participating in the distance/category they have selected, the cut off times, the route profile and level of difficulty of this event. If they are unsure, it is the participants duty to ask further information from the organizer.

𝐁. Participants acknowledge that by participating in such an event, they accept that the event is challenging and that this event is for experienced athletes who have not only trained sufficiently for the distance and but are conditioned and trained for such an event and understand the dangers and risks of participating in such an event.

Participants also understand and accept the risks in participating in such an event in a natural surrounding and they are therefore exposed to the elements and the dangers of nature and are responsible for ensuring they have the correct mandatory kit as stated under “Mandatory Kit” in their possession at all times during the event and will utilize the right gear or equipment to ensure they are protected from the elements such as heavy rain, cold, winds and heat.

𝐂. Participants understand that medical response to an emergency on the race course route emergencies may take timebe slow due to the nature of the event and remote location s of this event and any medical response and evacuation may take longer than normal.

𝐃. The organization reserves the right to withdraw the privilege of running in this race if a participant is found to be acting against the spirit of the race by:
 

1 - Missing key items from their mandatory kit list before/during/at the finish line of the event

2- Cheating or acting against the spirit of fair competition

3- Illegal bib swap without the approval of the organizers

4- - Removingal of markers

5- Throwing/dumping of rubbish on the race course or the venue for the event

6 - The use of foul or abusive language, be it verbal or written in public or on social media, before, during or after the event or on social media or social sharing means.

7- Acting outside of the social norms of the running community and do not abide by the spirit of competition.
 

Participants may be disqualified from the event if found to have infringed any of the above.

Participants found to be acting against the best interest of the event may also be disqualified

E. Appeals may be made to the race director but any appeals should be done in a sensible manner and based on facts and correct information. Competitors agree to abide by any adjudication by the race director, which will be final. All appeals should be filed as soon as possible with the race director in a calm manner and based on facts by emailing:

within 24 hours of the end of the event.

F. Appeals or complaints must be done by the individual runner who has registered to participate in the event and the individual must must be submitted in writing to the race director no less than 24 hours after the event via email to the organization official email address. The identify themselves with full name and bib number whenty of the person making an appeal or complaint to the organizer.must be clearly stated for transparency’s sake.

FG. Cut-off times are there for your safety and wellbeing as well as to ensure the smooth flow of the event once it begins and to ensure participants do not lag too far behind the main group of participants.

If runners fail to arrive or depart their check points before the cut off times, they will be stopped from proceeding and will have been disqualified and cannot proceed on the race course and continue the event.

Runners who fail to meet cut off times will be stopped at designated check points and dropped off at a designated location in Kundasang where they may arrange transportation home.

GH. Any runner opting to withdraw from the event must inform the race organization or the race marshal at a check point

H.I. A support crew may NOT transfer or replace equipment such as shoes or collect items from the mandatory pack to reduce the weight of the mandatory kit in the participants race pack. Any participant found to have received aid in this manner will be penalized and issued a warning. A second violation will mean disqualification.

IJ. Due to stringent Covid-19 restrictions on the number of participants allowed in an event and restrictions on the number of members of the organizing team (Phase The race director and/or the Chief Medical Officer have the right to make important medical decisions which include withdrawing a participant during the event or at the end of the event if further medical treatment is required for the wellbeing of the individual participant and/or evacuating an individual to the nearest medical facility for urgent treatment. 3 as of 22/10/2021), runners who fail to meet cut off times will be stopped at designated check points and dropped off at a designated location in Kundasang where they may arrange transportation home.

K. For participants who have purchased transportation from us for the event, transfers back to Kota Kinabalu will be organized as a van capacity is filled and under the management of a designated logistics manager.

L. We do not provide a shuttle service from Kundasang back to the Start line to collect vehicles.

𝟕-𝐂𝐨𝐯𝐢𝐝-𝟏𝟗 𝐏𝐫𝐨𝐭𝐨𝐜𝐨𝐥𝐬 Isnt this a repeat of no. 3?)

There will be a staggered start system based on a first come first basis for this event.

Group 1-3.00am-50 runners*

Group 2-3.05am-50 runners*

Group 3-3.10am-50 runners*

Group 4-3.15am-50 runners*

*Number of participants per group subject to change according to revised SOP’s by “The Authorities.”

𝟗7-𝐈𝐧𝐬𝐮𝐫𝐚𝐧𝐜𝐞 𝐂𝐨𝐯𝐞𝐫𝐚𝐠𝐞 Repeat?

All participants must be insured in order to participate. Insurance coverage is 21 years of age to 65 years of age on the event date. All participants are required to purchase a basic insurance coverage from the organizer to fulfil regulations. They may however purchase separate insurance policy that offers greater flexibility and coverage if they feel it is necessary.

𝐄𝐯𝐞𝐧𝐭 𝐈𝐧𝐬𝐮𝐫𝐚𝐧𝐜𝐞 𝐏𝐨𝐥𝐢𝐜𝐲 𝐄𝐱𝐜𝐥𝐮𝐬𝐢𝐨𝐧𝐬:

𝐓𝐡𝐞 𝐏𝐨𝐥𝐢𝐜𝐲 𝐝𝐨𝐞𝐬 𝐧𝐨𝐭 𝐜𝐨𝐯𝐞𝐫:-

1. Death or Disablement or any other loss caused directly or indirectly by:- (a) war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, mutiny or usurped power, strike, riot, civil commotion, military or popular uprising;

(b) insanity, suicide or any attempt thereat, intentional self-inflicted injury or any attempt thereat;

(c) general disease, infection or parasites;

(d) intoxication by alcohol or drugs;

(e) childbirth, miscarriage, pregnancy or any complications thereof;

(f) provoked murder or provoked assault.

(g) death injury illness charges or expenses of the Insured (ii) provide any indemnity against liability of the Insured

2. Death or Disablement or any other loss sustained by the Insured:- (a) while operating or riding a two-wheeled motor vehicle;

(b) while travelling in an aircraft as a member of the crew, except only as a fare-paying passenger in an aircraft licensed for passenger service. For the purpose of this exclusion the Insured would not be covered if the Insured is involved in any technical operation or navigation whilst in the aircraft;

(c) while committing or attempting to commit any unlawful act; directly or indirectly involved in illegal activities

3. Death or Disablement or any other loss consequent upon the Insured engaging in hunting, mountaineering, ice- hockey, polo-playing, steeple chasing, winter sports, yachting, water-ski jumping, underwater activities involving the use of breathing apparatus or using wood working machinery driven by mechanical power.

Attributable directly or indirectly to HIV (Human Immunodeficiency Virus) and / or any HIV related illness including AIDS and / or any mutant derivatives or variations thereof.

810-Support Crews:

Participants are allowed to receive assistance from a designated support crew during the event. All support crews must be registered with the organizer and must provide details such as names, mobile phone number and vehicle license plate and type of vehicle to be used on the day of the event for support purposes.

Support crews must abide by the spirit of the race and respect the event rules as do participants. They should not restrict, impede, interfere with the event. Their role is merely to provide food, drink, cold sponging and moral support for the event and not to interfere with the organization of the evenprovide runners with:t.

𝐏𝐨𝐢𝐧𝐭 𝐗 and Point Y will be explained to all participants and support crew drivers before the event.

9-Section Closed to Support crews:

𝐍𝐨 𝐬𝐮𝐩𝐩𝐨𝐫𝐭 𝐯𝐞𝐡𝐢𝐜𝐥𝐞 will be allowed to assist runners between 𝐏𝐨𝐢𝐧𝐭 𝐗 𝐭𝐨 𝐏𝐨𝐢𝐧𝐭 𝐘 𝐨𝐧 𝐭𝐡𝐞 𝐫𝐚𝐜𝐞 𝐜𝐨𝐮𝐫𝐬𝐞 as the route and road is too narrow and may impede runners on their way to the finish line from Point X to Point Y. It is also a vital route for farmers who regularly use the route between Point X to Point Y to transport their produce to Kundasang market.

Support drivers may proceed from 𝐏𝐨𝐢𝐧𝐭 𝐗 to the 𝐟𝐢𝐧𝐢𝐬𝐡 𝐥𝐢𝐧𝐞 or to 𝐏𝐨𝐢𝐧𝐭 𝐘 located 2km from the finish line to wait for their runners using the main road access from Kundasang to the Mesilau Golf Club where the finish line is located..

We will provide more details to all participants and their support crews before the event to demonstrate the location of Point X and Point Y.

𝟏0𝟏-𝐓𝐫𝐚𝐧𝐬port

Transport is available from Kota Kinabalu to the Start Line on a as a paid service departing at a set departure time from one designated location. It is the responsibility of the participant to ensure they are at the departure venue at least 15 minutes before departure time and have not forgotten any equipment or gear necessary for this event.

This transport service will be managed by a third party.

Departure times from the Finish line back to Kota Kinabalu will depart at staggered times as vans fill up and as runners finish. A designated logistics manager will handle transfers and his/her decisions will be based on capacity.(repeat also?)

However, if there are delays in transporting individuals beyond the control of the organizers or their appointed transport agent, runners understand they may need to wait as some matters are beyond our control.

The organizers do not provide transport service from Kundasang back to the Start line to collect vehicles during or after the event.

𝟏𝟐11-Drop Bag
 

𝐒𝐮𝐩𝐞𝐫𝐯𝐢𝐬𝐞𝐝 𝐃𝐑𝐎𝐏 𝐁𝐀𝐆 𝐚𝐧𝐝 𝐅𝐈𝐍𝐈𝐒𝐇 𝐁𝐀𝐆 𝐜𝐨𝐥𝐥𝐞𝐜𝐭𝐢𝐨𝐧 𝐰𝐢𝐥𝐥 𝐛𝐞 𝐝𝐨𝐧𝐞 𝐚𝐭 𝐭𝐡𝐞 𝐫𝐚𝐜𝐞 𝐒𝐓𝐀𝐑𝐓 𝐯𝐞𝐧𝐮𝐞 𝐮𝐩 𝐭𝐨 𝟏𝟓 𝐦𝐢𝐧𝐮𝐭𝐞𝐬 𝐛𝐞𝐟𝐨𝐫𝐞 𝐭𝐡𝐞 𝐬𝐭𝐚𝐫𝐭 𝐨𝐟 𝐭𝐡𝐞 𝐞𝐯𝐞𝐧𝐭.

Runners will have access to their drop bag which must have their bag tag attached after they have completed the 0KM-20KM route at a designated check point. The drop bag will be transported to the finish line once the check point has closed.

-Bag tags will be issued to runners for:

-Finish Bag (1 Bag Tag)

-Drop Bag (1 Bag Tag)

𝟏2𝟑-Postponement/Cancellation of Event

Participants 𝐚𝐜𝐜𝐞𝐩𝐭 that 𝐭𝐡𝐞 𝐫𝐚𝐜𝐞 𝐨𝐫𝐠𝐚𝐧𝐢𝐳𝐚𝐭𝐢𝐨𝐧 𝐫𝐞𝐬𝐞𝐫𝐯𝐞𝐬 𝐭𝐡𝐞 𝐫𝐢𝐠𝐡𝐭 𝐭𝐨 𝐚𝐥𝐭𝐞𝐫 𝐨𝐫 𝐩𝐨𝐬𝐭𝐩𝐨𝐧𝐞 𝐭𝐡𝐞 𝐝𝐚𝐭𝐞 𝐨𝐟 𝐭𝐡𝐞 𝐞𝐯𝐞𝐧𝐭 𝐨𝐫 𝐜𝐚𝐧𝐜𝐞𝐥 𝐭𝐡𝐞 𝐞𝐯𝐞𝐧𝐭 if it is due to circumstances beyond the control of the organizer. if 𝐧𝐞𝐜𝐞𝐬𝐬𝐚𝐫𝐲.

This includes

If the event the race needs to be cancelled due to orders from the State or Federal of the Government or any Sstate Aauthorities.

If the event cannot be organized at the planned venue which including start or finish line or entire race course beyond the control of the organizers, the race director reserves the right to alter, modify or change the race course start, finish or race course route.

Beyond the control of the organizers can mean , or if an EMCO, MCO is declared in Sabah or at the vedue to nue of the race, or due to a pandemic or due to severe bad weather, cannot be postponed, all finisher tees and medals will be distributed at the next event date. If the event is cancelled, or inability to attain all necessary permits before the event date due to Covid-19 issues, all finisher tees, medals and purchasedaid items will be couriered to registered runners outside of Kota Kinabalu within 30 days of the announcement of cancellation for free and/or can be collected in Kota Kinabalu and the event will be deemed to have been cancelled.

Under those circumstances, nNo requests for refund will be entertained.

However, OWEVER, aa special discount may be offered to runners for a future event organized by Avta Sports S/B or runners may transfer to another event organized by Avta Sports if the event cannot be postponed.

if it is deemed for the cancellation of the event. Avta Sports S/B shall determine the amount of special discount and their decision shall be final.

The final decision for this will be announced if possible.If a participant chooses not to participate in the event wherein the special discount is being offered, the offer of special discount will lapse and there will be no further offers thereof or offers of compensation..

𝟏3𝟒-Travel Insurance & Compensation for Travel & Expense if Event Cancelled or Postponed

159-7 Day Cooling-Off Period

A “7-day cooling period” means participants may request a full refund within 7 days from the date the participant made payment to Avta Sports Sdn Bhd to participate in this event.

A full refund can be requested within the 7 days of making payment without question.

No requests for refunds will be entertained after the 7-day cooling period has passed.

𝐃𝐞𝐚𝐝𝐥𝐢𝐧𝐞 𝐟𝐨𝐫 𝐚 𝐥𝐞𝐠𝐚𝐥 𝐛𝐢𝐛 𝐬𝐰𝐚𝐩 𝐢𝐬 𝟏𝐬𝐭 𝐅𝐞𝐛𝐫𝐮𝐚𝐫𝐲 𝟐𝟎𝟐𝟐 𝐯𝐢𝐚 𝐞𝐦𝐚𝐢𝐥. A small administrative fee may be charged for a bib swap.
